Asbest – eine gesamtgesellschaftliche Aufgabe

Asbest, diese mineralische Naturfaser, die aufgrund ihrer hervorrgenden Eigenschaften – durch Feuer kaum zerstörbar, säurebeständig, hohe Zugfestigkeit und trotzdem so elastisch, dass sie in Textilien verwebt werden kann – entsprechend vielfach und in verschiedensten Produkten Anwendung fand, sie macht krank! Diese Kenntnis über Asbest als Ursache von Asbestose, Lungenkrebs und Mesotheliom, dem Krebs des Bauch- und Rippenfells, sie ist nicht neu! Einiges davon ist bereits seit Ende des 19. Jahrhunderts bekannt und schon 1936 wurde in Deutschland die „schwere Asbeststauberkrankung (Asbestose)“ in die „Dritte Verordnung über die Ausdehnung der Unfallversicherung auf Berufs- krankheiten“ aufgenommen. Seitdem stieg die Zahl der neu anerkannten Fälle von Berufskrankheiten (BK) und der entsprechenden Renten stetig und rasant an.

The current development in the construction sector requires the revision of the building safety laws regarding the right of use and safety at work when activities involve the use or handling of asbestos or asbestos-containing materials. There is therefore an urgent need to establish a legal basis in public law to clearly define the duties and responsibilities of owners, builders and clients when it comes to identify the presence of asbestos and in so doing, to provide information on the location and condition of the asbestos containing materials to anyone who is liable to handle them. For the health and safety of users of the asebstos-contaminated buildings like tenants or the workers doing some renovation cannot be ensured without adequate information especially on hardly detectable asbestos contained in construction chemical products.
