REACH und Abfall – eine schwierige Geschichte

Die REACH-VO ist am 01. Juni d. J. in Kraft getreten. Abfälle i. S. der Richtlinie 2006/12/EG sind davon ausgenommen. Soweit aus Abfällen aber Wertstoffe zurück gewonnen und als Produkte vermarktet werden sollen, unterliegen diese als Stoffe, Zubereitungen und im Einzelfall auch als Erzeugnisse der REACH-VO. Anhand ausgewählter Wertstoffe aus Abfällen werden erste Überlegungen in einem schwierigen rechtlichen und fachlichen Umfeld angestellt und ein Ausblick auf kommenden Diskussions- und Handlungsbedarf gegeben. Besondere Probleme bei den Einstufungs- und Registrierungspflichten nach REACH dürften – neben vielen anderen – die Identität der zurück gewonnenen Wertstoffe mit bereits registrierten Primärstoffen (Stichwort tolerierbare Verunreinigungen) und genaue Angaben zu den in Wertstoffen enthaltenen anorganischen chemischen Verbindungen bereiten. Bei letzterem dürfte das nur in den wenigsten Fällen machbar sein.

The regulation (EC) no 1907/2006 concerning REACH has come into force on the first of June this year. Wastes for the purpose of the directive 2006/12/EG are exepted and not in the scope of REACH. On the other hand, in the case that reusable materials from waste as for example substances, preparations and in certain cases articles, are brought into market they are subject to REACH. On the example of selected reusable materials first considerations are reflected in the difficult field of law and applied science. An outlook is presented for the future need for discussion and action. Special problems in the field of registration might be – besides many others – the identity of reusable materials (substanes) in comparison to already registered primary substances (keyword tolerable impurities) and detailed information on inorganic chemical compounds therein. Such detailed information might possible only in a few cases.
